1. About These Terms
These Terms and Conditions ("Terms") govern the relationship between Plith ("we", "us", "our") and any individual or entity ("Client", "you") who engages our interior design services or uses our website at plithjf.site.
By enquiring about, agreeing to, or making payment for our services, you accept these Terms in full. If any part of these Terms is unclear, we encourage you to contact us before proceeding.
2. Our Services
Plith provides interior design consultancy and related services, currently comprising:
- Foundation Consultation — site visit, written brief, and reference palette
- Layered Design Package — full design service from spatial planning through specification
- Site Stewardship — procurement and site coordination during renovation
The scope, deliverables, timeline, and fees for each engagement are confirmed in a written service agreement provided before work commences. These Terms apply alongside, and do not replace, any service agreement.
3. Fees and Payment
Our published service fees apply unless otherwise agreed in writing. Fees listed on our website are design fees only and do not include the cost of materials, furniture, contractor works, or third-party services.
- A deposit is required before any work begins. The deposit amount is stated in the service agreement.
- Remaining fees are invoiced at milestones specified in the service agreement.
- Payment is due within 7 calendar days of invoice, unless otherwise agreed in writing.
- Late payment may result in work being paused until the outstanding balance is settled.
All prices are in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless stated otherwise.
4. Revisions and Changes
Each service includes a stated number of revision rounds. Revisions are defined as changes made within the scope of the original brief. Changes that alter the brief substantially — including significant changes to the property, space, or client requirements — may be treated as additional scope and quoted separately.
We will notify you before proceeding with any work that falls outside the included revisions.
5. Timelines
Estimated timelines are provided in good faith and are subject to factors outside our direct control, including client feedback turnaround times, contractor scheduling, material lead times, and site conditions.
We will communicate any material delays promptly. Delays caused by late approvals, unclear instructions, or significant brief changes from the client side may extend the timeline at no additional charge for time already allocated.
6. Client Responsibilities
For a project to proceed effectively, we ask that clients:
- Provide accurate information about the space, any existing conditions, and budget constraints
- Respond to requests for feedback and approvals within a reasonable timeframe (typically 5 business days unless otherwise agreed)
- Ensure access to the property for site visits and measurements as required
- Communicate changes to requirements as early as possible
7. Intellectual Property
All design work, drawings, renders, specifications, and other materials produced by Plith remain our intellectual property until payment for the relevant phase has been received in full.
Upon full payment, you receive a licence to use the delivered materials for the purpose of realising the specific project they were prepared for. You may not reproduce, repurpose, or share these materials commercially without our written consent.
We retain the right to use completed project images (where separately consented to) and general design concepts for portfolio and promotional purposes.
8. Third Parties
Where Site Stewardship is engaged, we coordinate with contractors and suppliers on your behalf. We do not act as a contractor and are not responsible for the quality of work carried out by third parties, or for materials and products not specified or sourced by us.
We exercise care in recommending contractors and suppliers but cannot warrant their performance. Contracts for construction works are between you and the contractor directly.
9. Limitation of Liability
Our liability in connection with any service or project is limited to the fees paid for that specific engagement. We are not liable for:
- Consequential losses, including delays or costs arising from contractor errors
- Changes in material availability or price after specifications have been issued
- Outcomes resulting from client decisions made contrary to our written recommendations
Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence.
10. Cancellation
Either party may terminate an engagement by giving written notice. In the event of client-initiated cancellation:
- Work completed to the date of notice will be invoiced at the agreed rate
- Deposits are non-refundable where work has commenced
- Any costs already committed to third parties (such as ordered materials) may be passed on
If we need to withdraw from a project, we will give reasonable notice and refund any prepaid fees for work not yet delivered.
11. Confidentiality
We treat all client information — including property details, budgets, lifestyle information, and project documentation — as confidential. We will not share this information beyond what is necessary to deliver the services described in the service agreement.
12. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes will be subject to the jurisdiction of the Malaysian courts.
13. Changes to These Terms
We may update these Terms from time to time. The current version will always be available at plithjf.site/terms-conditions.html. Continued engagement with our services following any update constitutes acceptance of the revised Terms.
